Damp and mould compliance action plan
As part of the Housing (Scotland) Bill 2025, the most pressing issue will be addressing any damp, mould and other health hazards in the property before it becomes legislation at the end of Q1.
Review all maintenance records over the past 12 months for issues with condensation, mould or damp. Even if they’re minor, mark them for immediate professional inspection.
Ensure all extractor fans in the kitchen and bathroom are fully functional and allow proper ventilation.
If a tenant reports damp, you need a documented process to acknowledge, investigate and repair the issue within days, not weeks.

Energy Performance Certificate (EPC) action plan
By 2028, all rental properties in Scotland must be EPC band C or above. Whilst this isn’t a safety issue, it carries a huge cost implication for landlords and this strategic window (before potential rent caps) gives you time to align your asset’s value.
An EPC is only valid if it has been conducted by an accredited assessor who belongs to an organisation approved by the Scottish Government. As part of the certification, you will receive advice on how to achieve Band C+ ratings. This could involve insulation or heat pumps etc.
There’s no two ways about it, upgrades can be pricey. Set aside money now and proactively plan rather than rushing to meet the deadline.

Rent Control Areas (RCA) action plan
Functioning rent caps aren’t expected until 2027/28 but it’s time to strategically consider your rental yield before they’re enforced. Once law, any annual rent increase will be capped (max. 3%) and must be justified.
Ensure your property is fully compliant, EPC C+ with no repair issues or hazards and that you are comfortable with your current monthly rental rate.

If you’re selling or preparing for a new high-value tenancy, staging is key. This helps justify a higher rental valuation and attracts the right tenant.
